A
registered sex offender, Donald Joseph Smith, was arrested on
December 2, 2024, after authorities discovered he was residing in
violation of Oklahoma residency laws. Smith, 43, was also found in
possession of drug paraphernalia during the arrest.
Smith
was taken into custody at a trailer located in the 500 block of S.
Walker in Elk City, a residence that authorities confirmed is within
2,000 feet of multiple restricted locations, including a licensed
daycare center. Oklahoma law prohibits registered sex offenders from
living within 2,000 feet of schools, playgrounds, child care
facilities, and similar protected areas.
Investigation
and Arrest
Elk
City Police began investigating Smith’s residency after receiving a
tip about his presence in the area. The Oklahoma Department of
Corrections (ODOC) confirmed that Smith had failed to properly
register his change of address as required by law. Upon visiting the
trailer, authorities noted suspicious activity, prompting further
surveillance.
According
to the Elk City Police Department report, Smith had told several
individuals, including family members, that he had moved to Elk City
from Washington County. Smith’s inconsistent statements and failure
to follow sex offender registration procedures raised additional red
flags.
On
the day of the arrest, police executed a search of Smith’s
residence, during which they discovered drug paraphernalia, including
items associated with the use of controlled substances. Smith was
charged with Possession of Drug Paraphernalia in addition to
violations of Oklahoma’s sex offender residency laws.
Sex
Offender Registration Violations
Donald
Smith is classified as an aggravated sex offender due to a prior
conviction for Rape in the First Degree out of Custer County. As part
of his lifetime registration requirement, Smith must notify
authorities of any change in address and comply with residency
restrictions.
Under
Oklahoma law (57 O.S. §590), it is unlawful for registered sex
offenders to live within 2,000 feet of protected areas such as
schools, parks, and daycares. Failure to comply with these laws can
result in severe penalties, including imprisonment.
Bond
and Charges
Following
his arrest, Smith was transported to the Beckham County Detention
Center. He faces multiple charges, including:
